ROYAL MEDIA SERVICES LIMITED & RAMOGI FM V. JAKOYO MIDIWO

JUDGMENT OF THE COURT

1. By a Plaint dated 16^th December 2003, the Respondent, (Hon. Jakoyo Midiwo) filed suit for defamation against the appellants (Royal Media Service and Ramogi FM). At all material times, the Respondent was the Member of Parliament for Gem Constituency.

2. The particulars of the alleged defamation were that on the 15^th day of December 2003, the appellants caused to be aired, broadcast and published as the main and leading item during the 7.00 am morning radio news the following words in Luo language defamatory of the Respondent herein:

dwaro Jakoyo Midiwo mondo okwer kata oyie to njok ok wayude...en wach ma omako wang dhano kabis…
