ADEIZA SADIQ V. THE STATE

JAMILU YAMMAMA TUKUR, J.S.C. (Delivering the Lead Judgment): This is an appeal against the judgment of the Court of Appeal, Abuja Judicial Division, in Appeal No.CA/A/628C/2016, delivered on 11th May 2018, against the Appellant.

The facts of the matter which culminated in this appeal arose from the arrest of the Appellant following an armed robbery incident involving Felicia Vincent who testified at trial as Prosecution Witness One ("PW1"). The Appellant was thereafter charged and tried before Hon. Justice J.J. Majebi of the Kogi State High Court of Justice for the offence of armed robbery, punishable under Section 298(c) of the Penal Code.

Upon conclusion of trial, the trial Judge, in a judgment delivered on 25th April 2016, found the Appellant guilty as charged and consequently sentenced the Appellant to 10 (ten) years imprisonment.
