TUKUR JCA: (Delivering the Lead Judgment): This is an appeal against the ruling of the Federal High Court, Lagos A Division, in suit No FHC/L/CS/1535/2013 delivered on 24 October 2014 by Honourable justice M. B. Idris in favour of the respondents. The material facts of the case culminating in this appeal are summarized thus: The appellant having obtained judgment against the 1st respondent in the High Court of Lagos State, in the case of Adebayo Lateef Sanni v. Unity Bank Plc with suit No. LD/303/ 2009, before Honourable Justice G. M. Onyeabo (Mrs.), brought an application via motion ex parte dated 27 November 2013 wherein he made the following prayers: An order directing the garnishee to appear in court and show cause in this matter, by filing and serving, within fifteen (15) days of the serving of this order , an affidavit showing why the judgment creditor should not be paid N41,936,100 and N1,000,00 representing the judgment sum in this case and the cost of the garnishee proc…
