A. G. KARIBI-WHYTE, J.S.C. (Delivering the Leading Judgment): On the 17th June, 1986 the Lagos Division of the Court of Appeal allowed the appeal by the Plaintiffs against the judgment of Bamgboye, J, of the High Court of Lagos State. This is an appeal by the defendant against the judgment of the Court of Appeal. We heard argument from learned Counsel to the parties on the 21st September, 1992, and reserved judgment for today. This I now proceed to state.
Plaintiffs issued a writ of summons dared 18th October, 1983 claiming from the defendant the following reliefs:-
(a) A Declaration that the plaintiffs are emit led to the possession of the landed property situate al and known as No.7A and 7B Egerton Road and No.3 Offin Canal, Lagos.
(b) Possession of the said landed property which is occupied by the Defendant.
(c) An injunction restraining the Defendant, his Agents and/or servants from further occupation of the said landed property.
