QUAYE J.: This action is a fall-out from the 158 special meeting of the University Council, the second defendant herein, which is by statutory provision, the governing body of the first defendant university. The plaintiff herein is a professor of French, has been dean of the Faculty of Social Sciences, since 1984, head of the Department of Languages and lecturer, an employee of the first defendant university. He has been a full professor since 1993, and a member of the governing council of the first defendant university since the 1988-89 academic year.

In this action, the plaintiff endorsed his writ with the following reliefs:

“(1) Declaration that the university council of the University of Science and Technology and the University of Science and Technology in exercise of its power under article 195(3) of the Constitution, 1992 to appoint a vice-chancellor is duty bound to follow its own earlier resolution adopted at the 157 meeting of the university council to follow the procedure ado…
