TSAMIYA JCA (Delivering the Lead Judgment): This is an appeal A against the decision of the Taraba State High Court (herein referred to as the trial court) delivered on 8/7/2004. In the trial court, the plaintiff took out a writ on the undefended list.

The plaintiff is a businessman, contractor and general supplier and carries on business in the following names and styles: U. K. and Sons Nigeria,
O. K. O. Stores,
I.G. Group of Company,
Our Brother Investment Nigeria.
That the defendant is a civil engineering company and has operational office in Jalingo, Taraba State.
That the plaintiff employed some staff to run the above named business outfits for him in Argungu in Kebbi State, Bauchi in Bauchi State and Maiduguri in Borno State.
