ADZIRA GANA MSHELIA, J.C.A. (Delivering the Lead Ruling): The applicant filed a motion on notice on 3rd day of March 2017 and same brought pursuant to Section 242(1) of the 1999 Constitution (as amended), Sections 15 and 24(4) of the Court of Appeal Act, and Order 6 Rule 9(1) and (2) of the Court of Appeal Rules, 2016.
