HARUNA SIMON TSAMMANI, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the Federal High Court of Nigeria, sitting in Abeokuta, delivered on the 27th day of May, 2010 by R. N. Ofili Ajumogobia, J in Charge No. FHC/AB/31C/2010.
Before the Court below, the Appellant was charged and arraigned as follows:
CHARGE
That you ADEWALE SHODIPO (M) on or about the 1st of March, 2010 at Papalantoro in Ogun State and within the jurisdiction of this Honourable Court and without lawful authority dealt in 750 grammes of cannabis sativa, a narcotic drug similar to Heroin, Cocaine or LSD and thereby committed an offence contrary to and punishable under Section 11(C) of the National Drug Law Enforcement Agency Act Cap. N30, Laws of the Federation, 2004.
