CHIOMA NWOSU-IHEME J.C.A. (Delivering the Leading Judgment): This appeal emanates from the judgment of the Akwa Ibom High Court, Ikot Ekpene Division delivered on the 12th of May, 2014 in suit No. HT/24/2010 by Stephen E. Okon, J.
The Appellant was sued by the Respondent at the trial Court along with the Commissioner of Works and Transport, Akwa Ibom State, The Commissioner for Housing and Urban Renewal, Akwa Ibom State, The Commissioner for Lands and Town Planning and The Attorney General and Commissioner for Justice Akwa Ibom State (2nd - 5th Defendants). The Appellant counter claimed.
SUMMARY OF FACTS: The Respondent is the owner of a Bungalow built along Ekanem Udom Road, Ikot Ekpene, Akwa Ibom State. The said building was built based on Government approved building permit and plan.
