JUDGMENT

BACKGROUND AND PRELIMINARY OBSERVATIONS  

Per an originating notice of motion filed on the 17th day of May 2016, the Applicant herein applied to this honourable Court for the enforcement of his fundamental human rights under Article 33 (1) of the Constitution of the Republic of Ghana, 1992. 

It is observed that the Applicant’s originating motion fails to particularise the specific relief(s) or remedy he seeks from the Court. This default violates Order 67 Rule 2 of the High Court (Civil Procedure) Rules, 2004 (C.I. 47). The Rule dictates the mode of submission of applications like the instant. The said Rule provides:  

(1) The application shall be made to the Court by motion supported by an affidavit signed by the applicant or by the applicant’s lawyer and shall  contain the following particulars 

(a) the full name and address for service of the applicant and the lawyer of the applicant; 

(b) the facts upon which the applicant relies;

(c) the relief or remedy sought by the applicant…
