1. At the time the Appellant/Applicant filed this suit at the trial Court, it also brought criminal complaint on the subject matter of this appeal against the respondent at Nigeria Police Force, Special Fraud Unit (SFU), Milverton Road, Ikoyi, Lagos through its management. 

2. That in the course of the criminal investigation by the said SFU, both the Appellant/Applicant Representatives and the Respondent’s Representatives were severally invited by the police.
