The sole issue for determination in this appeal is which of the parents should have custody of the child, Aaron Nalikem Awoonor Williams. We will refer to the parties as petitioner and respondent as they were in the trial District Court (Family Tribunal), the father as respondent and the mother as petitioner. The trial family tribunal found for the respondent father but on appeal to the High Court the decision was reversed. The trial High Court gave custody of the child to the petitioner. The respondent being the natural father of the child is aggrieved and is seeking rehearing of the case praying that we reverse the High Court order and reinstate custody of the child to him.
At the time of instituting this application for custody in August 2016 the child who had been with the petitioner the whole of his life was 8 years old, born on the 15th of April 2008.
