J U D G M E N T
The Applicants are in this Court for a declaration and an Order of injunction by way of an application for judicial review filed on 19th July, 2018. The reliefs sought are as follows:
a. A declaration that the Cylinder Re-Circulation Model Policy which the National Petroleum Authority intends to implement is inconsistent with the National Petroleum Authority Act, 2005 (Act 691) and thus null and void.
b. A declaration that the Cylinder Re-Circulation Model Policy is unreasonable, illegal and contrary Article 23 of the 1992 Constitution and thus null and void.
c. A declaration that the Respondent has no power to limit the scope of the licenses granted to the Applicants except in accordance with the National Petroleum Authority Act, 2005 (Act 691).
d. An order of injunction to restrain the Respondent from carrying out or causing to be carried out a categorisation of any LPG Retail Station in Ghana.
