CHINWE EUGENIA IYIZOBA, JCA (Delivering the Lead Ruling): This is another of the several disputes that have arisen between the parties herein arising from banker customer relationship which has turned sour. The 1st and 2nd Appellants in the action filed by them at the High Court of Lagos State are claiming the sum of "N10,000,000,000.00 (Ten billion Naira) as damages for falsified statement of account front loaded filed against the claimants by the defendant in ID/241/2007 on the 24th of September, 2007".

Parties have exchanged pleadings and trial commenced with the Appellants who are Claimants leading evidence in chief. It was at this stage the Appellants filed the application that resulted in this appeal. It must be observed that the 1st Appellant who is not a legal practitioner withdrew his instructions to counsel and decided to conduct this matter by himself and disregarded the advice of the trial court that he should engage another legal practitioner.
