HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A.(Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Bauchi State delivered in Suit No BA/27 /2008 by Honorable Justice Rabi T. Umar on the 17th of March, 2016. The Appellant, along with two other persons, was arraigned before the lower Court on a four count amended charge for conspiracy to commit illegal acts, namely cheating, criminal breach of trust and criminal misappropriation; fraudulently and dishonestly inducing many people through his business Cash Splash Network to deposit various sums of money amounting to over N200 Million in various bank accounts provided by his converting the said sums of money amounting to over N200 Million into his use while depriving the depositors a pay off; and dishonestly misappropriating the various sums of money belonging to the investors. The offences were said to be contrary to Sections 97, 309, 312 and 320 of the Penal Code Law of Bauchi State.
