IBB-KUU TITUS V. DERY ZIEM

JUDGMENT

Dr. POKU ADUSEI, JA: 

The plaintiff/appellant [hereinafter referred to as the appellant)  commenced legal action in the Circuit Court, Lawra in the Upper West  Region against the defendant/ /respondent (hereinafter referred to as the  respondent). By the endorsement on his amended writ of summons and  accompanying statement of claim, the appellant claimed the following  reliefs: 

(i) A declaration of title to all that piece or parcel of land  situate, being lying at Tolibr and bounded on the south by the Lawra Babile main road, to the west by the land of David Dery, to the north by  the building belonging to Robert Dery, and to the east by the  defendant’s land. 

(ii) Perpetual injunction restraining the defendant, all  those claiming through or under the defendant, his assigns, workmen or  agents from interfering with plaintiff’s rights to and possession of the  land. 

(iii) Costs of this suit on full indemnity.
