MUSLIM SULE HASSAN, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Justice of Ondo State, sitting at Akure, delivered by his lordship, Hon. Justice W.R. Olamide, on the 26th day of January, 2023, in Charge No. CA/AK/32C/2022, wherein the trial Court found the Appellant guilty of the one count charge of unlawful sexual intercourse with a child and sentenced him to five years imprisonment.

The one count information filed against the Appellant is for the following offence.

STATEMENT OF OFFENCE

UNLAWFUL SEXUAL INTERCOURSE WITH A CHILD, contrary to Section 31 (1) and punishable under Section 31 (2) of the Ondo State Child’s Rights Law, 2007.

PARTICULARS OF OFFENCE

OLUWADARE TOLAJU, on or about the 8th day of August, 2012 at about 4:00pm, at Kajola Camp via Ala, within the Criminal Jurisdiction of this Court, had unlawful sexual intercourse with one Ruth Jerry ‘F’ aged 6 years.
