ABUBAKAR SADIQ UMAR, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the National Industrial Court of Nigeria, Lagos Division (“the lower Court” or “the trial Court”) delivered on the 19th day of April, 2016 coram Oyewumi Oyebiola Oyejoju J. in Suit No: NICN/LA/580/2013 wherein the lower Court gave judgment in favour of the Respondent. 

The Respondent as Claimant at the lower Court on the 30 October, 2013 took out a Complaint accompanied by a Statement of Facts dated 24 October, 2013 against the Appellant seeking the following reliefs: 

1. A Declaration that the non-remittance and or failure to produce evidence of remittance by defendant of the Claimant’s contributions to the Nigeria Social Insurance Trust Fund (NSITF) for the months of January 1994 to December 1998, January 1998 to August 2001 and August 2004 is wrong, unlawful and malicious and or negligent in the circumstances of the case.
