PHILOMENA MBUA EKPE, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of R.D. Harriman of the Delta State High Court of Justice, Holden at Effurun Division delivered on the 8th day of May, 2012, wherein the trial Court found in favour of the Respondent against the Appellant.

The claims of the Respondent before the lower Court are as follows:

a) The sum of N1,246,875.00 (One Million, Two Hundred and Forty-Six Thousand, Eight Hundred and Seventy five Naira) being the total sum of money wrongfully deducted from the claimants salary without his consent and/or authority beginning from the 25th of July, 2007 to the 25th day of January, 2009 by means of equal monthly installments of the sum of N65,625.00 (Sixty-Five Thousand, Six Hundred and Twenty Five Naira) in respect of one status car, a Toyota Corolla 1.8 (ABS) with Registration No. CW 04 LSD (Lagos) given to the claimant as a Manager of the Defendants Effurun branch of the bank
