LATEEF ADEBAYO GANIYU, J.C.A. (Delivering the Lead Judgment): This judgment emanated from the judgment of Edo State High Court of Justice delivered on 17th day of October, 2018 Coram U. I. Erameh J. which is contained at page 290-309 of the record, wherein the trial judge dismissed the claimant’s claims (hereinafter called the “APPELLANT“) and granted the counter-claim of the Defendant (hereinafter called “the RESPONDENT”). 

Miffed by the said decision, the Appellant lodged an appeal against same vide his Notice of Appeal filed on 11/1/2019 which is contained at page 310-311 of the record of appeal, setting out a sole ground of appeal which without its particular runs thus: 

“The learned trial judge erred in law when he proceeded with the case when there was no valid and competent processes before the Court. “
