ITA GEORGE MBABA, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of Enugu State High Court in Suit No. E/131/2012, delivered on 7th November, 2018, by Hon. Justice A.R. Ozoemena, whereof the learned trial Judge dismissed the claims of the Plaintiffs (now Appellants) and granted the claims of 1st set and 2nd set of Defendants, as per their counter-claims, respectively.
At the trial Court, Appellants, as Plaintiffs, had sought the following reliefs:
(a) A declaration of title in favour of the Plaintiffs over the parcels of lands on the right side of the road leading to Ugwogo Nike, starting from Ngene Oyi river to Iyiukwu river, which includes: Enu Ekpe land, Ariuno land, Akpalata 1, Idime/Agu Offia Land, Onuiyikwu land, Offia Iyikwu land, Toto land, Akpalata lji, Akpalata lji/Onyeachonam Farm land and Owele Idume land, bounded by Edem Nike land, not in dispute; lands on the left hand side of the road, which includes Ogboekwu/Four Cornerland, Njesike land, …
