<p><strong> SHOREMI JCA (Delivering the Lead Ruling): </strong> The applicant brought the application before this court seeking the following relief:</p><p>Extension of time within which the defendant/applicant may apply for leave to appeal to the Court of appeal against the judgment of the Benin High Court in suit No. B/687/97 delivered by honourable Justice J. O. Sadoh on 26 March 2001. Leave to appeal against the said judgment and Extension of time within which to file the notice and grounds of appeal against the said judgment, time allowed by statute to file such appeal having expired.
