<p>SAMUEL CHUKWUDUMEBI OSEJI, J.C.A.(Delivering the Leading Judgment): The Respondent herein had as claimant in the lower Court brought an action by a writ of summons dated and filed on the 8th day of September, 2009 against the defendants (now Appellants).</p><p>In paragraph 12 of the statement of claim filed on 12/10/2009 the Respondent claimed as follows:</p><p>12.
