UZOMA V. NIG. RAILWAY CORPORATION

ALI ABUBAKAR BABANDI GUMEL, J.C.A. (Delivering the Lead Ruling): This ruling is sequel to a motion on notice dated 24th October, 2018 but filed on 13th November, 2018. The motion was brought pursuant to Order 7 Rule 10 (1) of the Court of Appeal Rules, 2016, Section 242 of the 1999 Constitution of the Federal Republic of Nigeria, as amended and under the inherent jurisdiction of this Court. 

The Applicant seeks for the following main reliefs. They are: 

"a. AN ORDER for extension of time within which the Applicant may seek leave to appeal against the decision of the High Court of Rivers State sitting at Port Harcourt in a Ruling dated the 9th day of October, 2012 in Suit No PHC/2850/2010 - Kingsley Uzoma v. Nigeria Railway Corporation.

b. AN ORDER for leave for the Applicant to appeal against the decision of the High Court of Rivers State sitting at Port Harcourt in a Ruling dated the 9th day of October, 2010 in Suit No. PHC/2850/2010 - Kingsley Uzoma v. Nigeria Railway Corporation.
