Judgement

MOHAMMED AMBI-USI DANJUMA, J.C.A.(Delivering the Leading Judgment): This is an Appeal against the decision of the Appellate High Court of Justice, Benue State sitting in Gboko in Appeal No.GHC/4A/2001 which was delivered on 31st May, 2001.

The Appellants herein were the Respondents at the lower court, whereto the present Respondent and others had Appealed in respect of judgment which they had lost at the Grade I Area Court Gboko in suit No.CV/28/2000 which was decided on 21/1/2001, dismissing their claims for declaration of title to land, and an order for perpetual injunction and in their stead granting the Appellants' counter claim.

The Appellate High Court reversed the trial court's decision as stated above and allowed the Appeal of the present Respondent and dismissed the counter claim of the present Appellants.
