Judgement

MODUPE FASANMI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of an Ogun State High Court of Justice sitting in Ota delivered on the 6th of May, 2004.

By its Amended Statement of Claim, the Appellant as Plaintiff at the lower court claimed against the Respondents as Defendants:

1. A Declaration that the Plaintiff is the person entitled to the Right of Occupancy and Certificate of Occupancy over the following landed properties:

a. ALL THAT parcel of land measuring about 3505.392 square meters lying behind no 15, Idiroko Road, Sango-Otta and shown on the survey Plan No.LAA/OG 1237 drawn by A. A. LAKANU (Licensed Surveyor).

b. ALL THAT parcel of land (together with the development therein) consisting of the old U.B.N building (i.e. U. B, A temporary premises Sango-Otta) situate along Idiroko Road, Sangootta and covered by the survey Plan No.LM/OG/237 drawn by A. A. LAKANU (Licensed Surveyor).
