Judgement

JUDGMENT 

The brief facts of this case as captured by the statement of claim of the Plaintiff are that: 

The Plaintiff is a businesswoman and owner in possession of all that parcel of land described in the schedule below which is situate at New Bortianor, Accra. The Defendant is a trespasser on  Plaintiff’s land who lives in Accra. 

Plaintiff says that sometime in the year 2008, she took a grant of land described in the schedule  below from Nii Akotey IV, Dzaasetse and acting Bortianor Mantse who was the lawful  representative of the Bortianor stool with the tacit approval of the principal members of the said  stool. 

Plaintiff contends that after the said grant was made to her, she took physical possession of the  land which was then bare and swampy, in the full glare of the whole world including Defendant  without any let or hindrances. 

Plaintiff says in pursuance of paragraph 3, she obtained 880 trips of laterite soil to fill up the land  which was swampy with weeds.
