Judgement

MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): The 1st Appellant had summarily dismissed the Respondent, a member of its staff, vide a letter dated the 30/4/99 and being aggrieved thereby, the Respondent had filed an action before the Federal High Court, sitting at Calabar in Suit No. FHC/CS/13/2000 against the Appellants. At the end of trial, judgment was entered in favour of the Respondent on the 18/10/2010 and it is against the said judgment that the present appeal was filed.

In line with the Rules of practice in the court, learned counsel for the parties filed their respective briefs of argument in support of their positions in the appeal. In the Appellant's brief filed on the 17/3/2011, the learned Senior Counsel for the Appellant, Mr. Joe Agi, has raised three (3) issues from the five (5) grounds of the appeal for decision by the court. They are:-

"1. Whether the Respondent who pleaded her conditions of service but failed to tender same had discharged the burden…
