Judgement

MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): This appeal is against the same judgment of the National Industrial Court, Lagos delivered on the 23rd February, 2012 as in Appeal No. CA/L/682/14.

At the hearing of the appeal, learned Counsel for the parties agreed that this appeal shall await and abide by the decision of the Court in Appeal No. CA/L/682/14.

In the result, this appeal is dismissed for reasons set out and in terms of the judgment in Appeal No. CA/L/682/14.

JOSEPH SHAGBAOR IKYEGH, J.C.A.: I had the honour of reading in draft the judgment prepared by my learned brother, Mohammed Lawal Garba, J.C.A. (Hon. P.J.), with which I agree with nothing extra to add.

YARGATA BYENCHIT NIMPAR, J.C.A.: I was privileged to read the judgment in CA/L/683/14 which parties agreed to bind this appeal. Having dismissed that appeal, this appeal also stands dismissed for reasons succinctly set out in that judgment.
