BELGORE, J.C.A. (Delivering the Leading Judgment): General Election were held nationwide on Saturday, the 14th day of April, 2007 and Alhaji Abdulkadir A. Zaranda (now the 1st appellant) of the All Nigerian Peoples Party (now ANPP) was declared winner and returned as the elected member of the Bauchi State House of Assembly, representing Toro/Jama'a Constituency of Bauchi State. He pulled 29,286 votes of the total announced by the Independent National Electoral Commission (now INEC) on the 15th day of April, 2007. Alhaji Isa Babayo Tilde (now 1st respondent), the candidate of the People's Democratic Party (now PDP) scored 18,727 being the second highest number of votes. Alhaji Suleiman D. Gambo of the Action Congress came third with 2,138 votes.
Being dissatisfied with the results of the election as announced by the INEC, the 1st respondent filed a petition on the 10th day of May, 2007 challenging the 1st appellant as winner of the election.
