OGUNTADE, J.C.A. (Delivering the Leading Ruling): The Ikeja High Court on 1/2/2000 refused the application of the applicant for an order quashing a 4 Count Charge brought against the applicant. Dissatisfied, the applicant brought an appeal before this court. On 11/12/2000, this court in its judgment dismissed the appeal. The applicant was dissatisfied and has further appealed to the Supreme Court. He brings this application for an order staying proceedings in charge No. ED/43C/99 pending the determination of his appeal to the Supreme Court.
We heard arguments on the application on 27/2/2001. Mr. J. B. Daudu, SAN, for the applicant argued the application in the terms of the papers filed. He said that the applicant had a Constitutional right of appeal and that the grounds of appeal raised serious issues of law.
