Judgement

CHUKWUMA-ENEH, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the tribunal in which it held thus:

"From what we have observed today ... the remaining two petitions which expire midnight tomorrow are also incapable of being heard, concluded and decided within 24 hours or so.

In view of this the two petition:

(1) BNS/LGET/MZ/8/98 Patrick B. Aboje and Anor. v. Godwin A. Udo and Ors.

(2) BNS/LGET/MZ/25/98 John Abah v. Daniel Robert and Anor.

shall also abate w.e.f. midnight tomorrow".

Dissatisfied with the ruling, the appellant/petitioner has appealed to this court predicating his appeal on 4(four) grounds. The two issues for determination as adumbrated in the brief's for the 3rd and 4th respondents seem to me to encompass the issues as contemplated in the brief's by both learned counsel for the appellants and 1st and 2nd respondent and so I adopt same for purposes of the appeal.
