J U D G M E N T
For an otherwise simple road traffic accident that occurred on an ordinary and fine day in Takoradi, the cases whose trial has led to the instant judgment seem to raise rather delicate, and somewhat complicated, hence difficult, issues of law, equity and public policy.
Incidentally, I have not chanced upon any decided authority that appears to come anywhere near to fully covering the rather peculiar facts and special circumstances of the instant consolidated cases. We almost seem to be navigating across uncharted waters here.
The Plaintiffs herein seek compensation for the injury and loss which they claim to have suffered as a result of a road traffic accident. There seems to be little difficulty, in establishing the fact that there are victims of the accident. There is, however, hot controversy as to who should bear legal responsibility for the injury and loss allegedly suffered by the Plaintiffs herein as a result of the accident.
