ADEYEYE J (Delivering the Ruling): In a writ of summons dated 22nd day of September, 2006, the plaintiffs/applicants sought the following reliefs against the defendants/respondents:
“(1) An order directing the 1st, 2nd, 4th and 5th defendants to account and refund all monies deducted from the salaries of Secondary School tutors with effect from October 2005 when the Ministry of Justice, Ekiti State directed them to stop the deduction of check off from their hard earned salaries.
(2) A declaration that the plaintiffs in Ekiti State have a legal and fundamental right to their salaries without any deductions from the 1st, 2nd and 5th defendants.
(3) A declaration that under the 1999 Constitution, membership of any association or union is voluntary and the same 1999 Constitution is supreme to any other law.
(4) An order of perpetual injunction restraining the 1st, 2nd and 5th defendant from further deducting plaintiffs’ salaries in Ekiti State in favour of any association or body.
