ABIMBOLA OSARUGUE OBASEKI-ADEJUMO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Ruling of the Federal High Court, sitting in the Lagos Judicial Division, coram SHAGARI, J., delivered on 6th October, 2011 in Suit No:FHC/L/CS/298/2016.
The 1st Respondent filed an Application dated 26th May, 2017 contained at pages 1 - 25 of the Records of Appeal; written address in support of the 1st Respondent's Motion is contained at pages 26 - 30 of the Records of Appeal. The Appellant filed a Counter-Affidavit and Written Address in opposition to the 1st Respondent's Application as contained at pages 42 - 47 of the Records of Appeal. The Lower Court granted the 1st Respondent Application in the Ruling made on the 6th day of October, 2017.
