DANLAMI ZAMA SENCHI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of the Federal Capital Territory, Abuja delivered by Valentine B Ashi, J. (of blessed memory) on 15th February, 2018 in suit no. FCT/HC/CV/2751/2016.
Briefly put, the facts which led to this case on appeal as disclosed by the record of proceedings before this Honourable Court are as follows:-
The Respondent herein was the Plaintiff before the High Court of the FCT, Abuja whereat he had instituted an action by writ of summons against the Appellant herein (as the defendant) claiming special and general damages for breach of contract. Pleadings were exchanged and the matter went to trial. The Respondent's statement of claim is at pages 5 - 11 of the Record of Appeal while the Appellant's statement of defence is at pages 48 - 53.
