FABIYI JCA (Delivering the Lead Judgment): This is an appeal against the judgment delivered by Saula J while sitting at the High Court of Justice, Sagamu in Ogun State of Nigeria on 30th July, 2004. In the judgment, the claims of the plaintiff at the trial court and respondent herein were substantially granted as prayed.
