Judgement

ADAMU JAURO, J.C.A. (Delivering the Leading Judgment): The appeal herein is against the ruling of the Sharia court of Appeal, Taraba State sitting in Jalingo delivered on 4th October, 2011 in case number TRS/SCA/CV/ACNG/GM/M/7/2011.

The facts giving rise to this appeal can be compressed as follows: The appellants as applicants by motion on notice dated 22nd April, 2011 and filed on 29th August, 2011 prayed for the following reliefs before the lower Court, namely:

"1. An order extending the time within which the Applicants may apply for leave of this Hon. Court to appeal against the Judgment of Grade 1, Area Court, Nguroje delivered on 6/1/2004 by Honourable Faruk M. Idris, PACJ1.

2. An order granting the Applicants leave to appeal to this Honourable Court against the said decision of Grade 1, Area Court, Nguroje herewith and marked as Exhibit "D1".

3. An order deeming the Appellants'/Applicants' Notice and Grounds of Appeal herewith attached and marked as Exhibit "D" as properly filed…
