JUDGMENT

INTRODUCTION

This is an appeal against the decision of the Circuit Court, Offinso dated the 15 day of May, 2023 which dismissed the plaintiffs/appellants’ claim against the defendant/respondent. In this judgment, the plaintiffs/appellants will be referred to as the plaintiffs while the defendant/respondent will be referred to as the defendant.

THE FACTS

The facts that gave birth to the instant appeal are devoid of any complexities and may be summed up as follows:

One Opanin Kwaku Amankwaa admittedly a wealthy man by all standards during his lifetime. He doubled as the Odikro of Bonsua as well as the head of family to which the late Kramo Seidu Alias Kwasi Tire belonged.

The plaintiffs are the surviving children and widows respectively of Kramo Seidu. The late Opanin Kwaku Amankwaa acquired some properties including a parcel of land lying and situate at a place commonly known and called Brepro, Achiase Bonsua on Offinso Stool land.
