BIOBELE ABRAHAM GEORGEWILL, J.C.A. (Delivering the Leading Judgment): This is an Appeal against the Judgment of the High Court of Delta State, Coram: T. O. Diai J., in Charge No. A/74C/2015: The State v. Samuel Osadebe and 2 Ors., delivered on 19/6/2018, wherein the Appellant, who was the 2nd Accused Person before the Court below, was convicted on Counts 1, 2, 3, 4, and 5 for the offences of Armed Robbery and sentenced to death, and Conspiracy to Commit Kidnapping and Kidnapping and sentenced to ten years imprisonment but was acquitted and discharged on Counts 6 and 7.

​The Appellant was peeved with the said judgment and had appealed against it to this Court vide his Notice of Appeal filed on 20/7/2018 on one ground of appeal at pages 182 - 184 of the Record of Appeal. The Record of Appeal was transmitted to this Court on 16/4/2019 but was deemed as properly compiled and transmitted on 23/6/2021.
