Judgement

TOM SHAIBU YAKUBU, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of Hon. Justice E. U. Uzodike, holden at the Ogidi High Court of the Anambra State High Court of Justice, delivered on 20th July, 2009.

The respondents, had claimed declaratory and injunctive reliefs with damages against the appellants, in the following terms, to wit:-

"a. a declaration that the plaintiffs are the persons entitled to a statutory right of occupancy under the Land Use Act of the parcel of land situate at Ugwu-Eke land, Ububa village, Nkpor shown verged green in survey plan No. EEO/AN.D023/2005.

b. N1,000,000 being damages for trespass.

c. Perpetual injunction restraining the defendants by themselves or through their servants, agents or privies from further entry into the land in dispute or from any other way interfering with the plaintiffs ownership and possession of the said land."
