Judgement

NGWUTA JSC (Delivering the Lead Judgment): Appellant and two others were arraigned on a two-count charge of conspiracy to commit armed robbery and armed robbery contrary to sections 6 (b) and 1(2) (a), respectively of the Robbery and Firearms (Special Provisions) Act Cap. R11, Vol. 14, Laws of the Federation of Nigeria, 2004. The charge was laid before the High Court of Justice of Ondo State, Akure Judicial Division. Appellant was the 3rd accused person. The prosecution alleged that appellant and his co-accusedpersons invaded the premises of Hon. Justice Williams Akin Akintoroye on 1 February 2008. They were armed and robbed the judge of the sum of N14,000.00 (fourteen thousand naira), two (2) laptop computers and other valuables, belonging to the judge and his household. It was al eged that the appellant and his co-accused inflicted various degrees of injury on the judge and members of his household.
