IGE, JCA: (Delivering the Lead Judgment) This is an appeal by thePlaintiff/Appellant against the Ruling of the Lagos High Court delivered on 17th February, 1998 in Suit No. LD/3223/95 wherein the learned trial judge refused the Appellant’s application for an adjournment of her case. In consequence of the refusal of an adjournment, the Appellant’s case was dismissed when she could not proceed with it. The Appellant was dissatisfied with the said Ruling and has appealed to this Court by filing a Notice of appeal dated 3rd Mach 1998, containing the following four grounds of appeal (The grounds quoted without their particulars) “(1) The learned trial judge erred in law in wrongfully refusing the Plaintiff’s application for an adjournment and thereby came to the wrong exercise of his judicial and judicious discretion contrary to the fundamental principles of the administration of justice.
