Judgement

MUNTAKA-COOMASSIE, JCA (Delivering the Lead Ruling): This is a motion on notice filed on 21st day of February, 2001 by the appellants who were the plaintiffs before the Federal High Court, Abuja, pursuant to Order 3 rule 4(1) and Order 7 rules 2 and 3 of the Court of Appeal Rules. The motion is seeking for the following reliefs.

(1) Enlargement of time within which to appeal against the judgment of the Federal High Court, Abuja in suit No. FHC/ ABJ/CS/164/2000 delivered on the 17th day of July, 2000 by Hon. Justice M. A. Edet.

(2) Leave to appeal against the said judgment described in paragraph 1 above out of time;

(3) On granting reliefs 1 and 2 above, an order abridging the time for filing briefs of argument in the appeal to 14 days to the appellants and 21 days to the respondents ;

(4) An order of court that the appeal be heard on the bundle of papers filed with this application and marked Exhibit ‘A’ ;
