MUSA DATTIJO MUHAMMAD, J.S.C. (Delivering the Leading Judgment): This is a further appeal against the judgment of the Ogun State High Court, hereinafter referred to as the trial court, before which the appellant, Godwin Awin and others then at large were tried for conspiracy to commit robbery and armed robbery contrary to Section 5 (b) and punishable under Section 1 (2) (a) of the Robbery and Fire Arms (Special Provisions) Act 1990 as amended by the Tribunal (Certain Consequential Amendments Etc) Act 1999.
Aggrieved by his conviction and sentence by the trial court, the appellant appealed to the Ibadan Division of the Appeal Court. The court, hereinafter referred to as the court below, in its judgment dated 28th October, 2010, affirmed appellant's conviction by the trial court but reduced the sentence imposed on him from death to life imprisonment.
