Judgement

JUDGMENT: 

The Petitioner and Respondent were married at the Cape Coast Municipal Assembly under the Marriage Ordinance 1884 – 1985 (Cap 127), on 19th December, 2005. The Marriage was evidenced by a Marriage Certificate Number 1998/2005 under License Number CCMA/ 394/2005. 

The Respondent who was served with the Petition, filed no appearance. He was however at the trial and informed the Court that he was not opposed to  the Petition for dissolution of the marriage between the parties, and did not intend to testify at the trial.

The parties did in fact file terms of settlement seeking a dissolution of the marriage and no order as to costs. The Court however heard the evidence of  the Petitioner to satisfy itself as to whether or not, the marriage had broken down beyond reconciliation, in accordance with sections 2 (2) and (3) of the  Matrimonial Causes Act 1971 (Act 367).
