MISITURA OMODERE BOLAJI-YUSUFF, J.C.A. (Delivering the Leading Judgment): The appellant herein instituted suit no. KWS/419/2018 for the enforcement of his fundamental human rights and sought the following reliefs:
1. “A declaration that the action of the respondent using, engaging and instigating Army Officers to embarrass, intimidate and to inflict psychological pain on the applicant and the respondent further threatening to embarrass, intimidate and traumatize the applicant when the applicant has not committed any offence, constitutes a flagrant violation of the applicant’s rights to human dignity, personal liberty and freedom of movement.
