Judgement

CHIDIEBERE NWAOMA UWA, JSC (Delivering the Leading Judgment): The appeal is against the judgment of the Court of Appeal, Kano Division (hereinafter referred to as the lower court), delivered on 11th September, 2020.

The brief facts of the appeal are that the Jigawa State High Court (hereinafter referred to as the trial court) presided over by Y. A. Kudu, J. in a judgment delivered on the 14th day of February, 2019, convicted the Appellant of the offence of rape contrary to and punishable under Section 283 of the Penal Code of Jigawa State and thereby sentenced him to life imprisonment.

Dissatisfied, the Appellant appealed against the said judgment to the lower court which affirmed the judgment of the trial court.

The Appellant further aggrieved with the affirmation of his conviction by the lower court appealed to this court. From the eight grounds of appeal filed, the following two issues were formulated for the determination of the appeal thus:
