Judgement

JUMMAI HANNATU SANKEY, J.C.A. (Delivering the Leading Judgment): This Appeal is against the Ruling of the High Court of Justice Borno State sitting in Maiduguri in Suit No. BOHC/MG/CV/2018 delivered on 4th December, 2018 by A.B. Kumalia, J.

The facts leading to the Appeal are briefly that: the Appellant herein initiated an action before the lower Court vide a Writ of Summons filed on 23-07-18 wherein they sought the following reliefs against the Respondents, as Defendants:

a. “A declaration that the 1st defendant’s act of revoking Shop No. E110 3 Bay Ramat Shopping Complex from the claimant is illegal, wrongful and unconstitutional.

b. A declaration that the subsequent re-allocation of Shop No. E110 3 Bay Ramat Shopping Complex for private purposes to the 2nd defendant is illegal, wrongful and unconstitutional.

c. A declaration that the allocation of Shop No. E110 3 Bay Ramat Shopping Complex to the claimant dated 24th day of May, 2003 by the 1st defendant remained valid and subsisting.
