JUDGMENT

This is an appeal by the Defendant, Respondent/Appellant, hereafter referred to as the Defendant, against the decision of the Court of Appeal, dated 28^th March 2013 which was in favour of the Plaintiffs/Appellants/Respondents, hereafter referred to as the plaintiffs. In a nutshell, whilst, the Plaintiffs, claims against the Defendant, (therein 2^nd Defendants) was dismissed by the judgment of the High Court, dated 21^st December 2011, the Court of Appeal on the 28^th March 2013 reversed the judgment of the High Court, and entered judgment in favour of the plaintiffs herein.

BRIEF FACTS

The facts of this case admit of no controversy whatsoever. The Plaintiffs are a non-banking financial institution incorporated in and under the laws of Ghana.
